Similar to the other H sort of visas, the H-3 visa cannot be started by the candidate. Instead, the candidate needs to find suitable training curricula and apply to be admitted. The organisation where the training event is being held should then start the H-3 visa procedure. As for H-1B, H-2A, or H-2B visas, the organisation must then appeal to the proper agencies for the H-3 candidate to be permitted a visa.
The training organisation that provides and organises the training must send a request to USCIS with the description of the training curricula or special education program that the candidate desires to join and also affix more documents such as:
- The employee of the training organisation
- The description of the candidate with specifics about:
- Education and previous gradations
- Previous training
- Job experience in the related arena that the training program will be about
- Whether the candidate will get any financial advantage from the training
- If it is a special education organisation, it should also show evidence that they provide such facilities or training
The training institution must file Form I-129, Petition for Nonimmigrant Worker to USCIS. The charge for the document is USD 460. This paper must be filled with the required information and sent to USCIS with the documents defined above. The appeal must be filed at a definite time, mostly more than six months earlier the training program will start. Next USCIS evaluates the documents and the Form I-129, they will make a decision and forward it to the training organisation. If they accept the request, they will send Form I-797 to the institution, which will support the applicant to apply for the visa. The acceptance of the appeal will indicate the training curricula or special education applicant to start applying for the H-3 visa. The visa appeal must be done at the U.S Embassy of the applicant’s home nation. The candidate must submit these papers:
- Fill out the Online Form DS-160 from the website of U.S Embassy
- Form I-129 and Form I-797
- Legal passport
- Birth record or certificate
- One photo meeting the U.S. Visa Digital Image Requirements
- Documents which show your commitment to go back to your home states such as an assets deed, flat lease, or future work agreement
- Reimburse the petition fee of USD 190
After submitting the papers, you will have to book an interview date. The interview will then be conducted to evaluate whether you are appropriate to join the training or special education program, and if you reach all the qualifications. In case of a positive reply, you will then obtain the visa stamp and will be prepared to join the program you have been admitted.
